These Terms of Service (“Terms”) govern your access to and use of the services provided by Legal Point Corp. (“Legal Point,” “we,” “us,” or “our”), including legal videography, remote proceedings, trial technician services, transcript syncing, interpreter coordination, legal video editing, and related litigation support services (collectively, the “Services”).
By engaging Legal Point Corp., scheduling services, or accessing our platforms or deliverables, you (“Client,” “you,” or “your”) acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree, do not use our Services.
§ 1. Scope of Services
Legal Point Corp. provides professional litigation support services including, without limitation:
■ Legal videography (in-person, remote, and hybrid)
■ Remote deposition and proceeding coordination
■ Trial technician and courtroom technology support
■ Transcript syncing and video alignment
■ International interpreter services
■ Legal video editing and evidentiary preparation
■ Secure file delivery and related technical services
Legal Point Corp. is not a law firm and does not provide legal advice. All Services are technical and facilitative in nature.
Client remains solely responsible for legal strategy, procedural compliance, admissibility determinations, and case management.
§ 2. Professional Role and Neutrality
Legal Point Corp. acts as a neutral technical service provider.
We do not advocate for any party, influence testimony, interpret legal meaning, or provide strategic guidance. All Services are delivered with professional neutrality and evidentiary integrity.
Client acknowledges that Legal Point’s role is limited strictly to technical facilitation and documentation.
§ 3. Scheduling, Confirmation, and Cancellations
Services are scheduled upon written or electronic confirmation.
Cancellation Policy
Unless otherwise agreed in writing:
■ Cancellations within 48 hours of a scheduled service may incur up to 100% of the quoted fee.
■ Same-day cancellations are non-refundable.
■ International or multi-day matters may carry custom cancellation terms.
Legal Point reserves the right to charge for preparation time, travel, staffing allocation, and reserved technical resources.
§ 4. Client Responsibilities
Client agrees to:
■ Provide accurate scheduling details and participant information
■ Ensure witness availability and cooperation
■ Comply with all applicable laws, court rules, and jurisdictional requirements
■ Obtain necessary permissions for recording testimony
■ Designate authorized contacts for instructions and approvals
Legal Point Corp. is not responsible for delays, failures, or disruptions caused by incomplete information, participant noncompliance, or external parties.
§ 5. Fees, Invoicing, and Payment Terms
Invoices are due upon receipt unless otherwise stated in writing.
Late balances may accrue interest at 1.5% per month (or the maximum permitted by law).
Client agrees to reimburse Legal Point Corp. for all reasonable costs of collection, including attorneys’ fees.
Legal Point reserves the right to withhold deliverables for accounts in arrears.
§ 6. Technology Limitations and Force Majeure
Client acknowledges that Services depend on third-party platforms, internet connectivity, power infrastructure, and participant hardware.
Legal Point Corp. is not liable for failures caused by:
■ Internet outages
■ Platform disruptions
■ Participant device malfunction
■ Power failures
■ Acts of God
■ Government action
■ War, strikes, or natural disasters
We implement professional redundancies but cannot guarantee uninterrupted operation in all circumstances.
§ 7. Deliverables and Intellectual Property
Unless otherwise agreed:
■ Client receives a limited, non-exclusive license to use deliverables solely for legal purposes related to the matter.
■ Legal Point Corp. retains ownership of workflows, methodologies, templates, and technical processes.
Client may not resell, redistribute, or commercially exploit deliverables outside their intended legal use.
§ 8. Confidentiality and Data Security
Legal Point Corp. maintains commercially reasonable safeguards including encrypted transfers, controlled access, and secure storage protocols.
Client acknowledges that no system is infallible.
Legal Point Corp. shall not be liable for unauthorized access caused by factors beyond our reasonable control.
§ 9. International Matters and Jurisdictional Compliance
For international proceedings, Client remains responsible for:
■ Local legal authorization
■ Recording permissions
■ Data privacy compliance (including GDPR where applicable)
■ Witness requirements
Legal Point Corp. provides technical coordination only and does not warrant jurisdictional admissibility.
§ 10. Limitation of Liability
To the maximum extent permitted by law:
Legal Point Corp.’s total liability shall not exceed the amount paid by Client for the specific Services giving rise to the claim.
In no event shall Legal Point Corp. be liable for:
■ Loss of profits
■ Loss of case advantage
■ Consequential damages
■ Strategic outcomes
■ Evidentiary rulings
■ Judicial decisions
Client acknowledges that litigation outcomes are inherently uncertain and independent of technical service performance.
§ 11. Indemnification
Client agrees to indemnify and hold harmless Legal Point Corp., its officers, employees, and contractors from any claims arising out of:
■ Improper recording authorization
■ Jurisdictional violations
■ Participant conduct
■ Client misuse of deliverables
■ Legal strategy decisions
§ 12. No Guarantee of Legal Outcomes
Legal Point Corp. makes no representation regarding:
■ Admissibility
■ Case success
■ Judicial acceptance
■ Strategic advantage
Our Services support litigation — they do not determine its outcome.
§ 13. Governing Law
These Terms shall be governed by the laws of the State of California, without regard to conflict-of-law principles.
Any disputes shall be resolved exclusively in courts located within California.
§ 14. Amendments
Legal Point Corp. may update these Terms periodically. Continued use of Services constitutes acceptance of any revisions.
§ 15. Entire Agreement
These Terms constitute the entire agreement between Client and Legal Point Corp. unless superseded by a written service agreement.
